Hamstr Terms of Service
Last updated: September 14, 2026 · Version: 1.0
These Terms of Service ("Terms") are a contract between you and Hamstr ("Hamstr," "we," "us"). Contact details are in Section 14. They cover the Hamstr Mac app, app.gethamstr.com, gethamstr.com, and related services (the "Service"). By accepting these Terms when creating an account or when prompted in the Service, you agree to them. If you don't agree, don't use the Service.
1. What Hamstr is
Hamstr is a personal study tool. You upload material you have (for example lecture slides or notes), and the Service uses automated systems, including third-party AI models, to make flashcards and related study aids for your own private study. Hamstr is not affiliated with, endorsed by, or approved by any school, university, instructor, or course.
2. Eligibility and accounts
You must be at least 16 years old to use the Service. If you're under the age of majority where you live, you may use it only with a parent or guardian's permission and supervision. This permission does not remove any legal protection you have as a minor or automatically make your parent or guardian liable for your obligations.
Keep your account details accurate and your login secure. You're responsible for activity you authorize and for taking reasonable steps to prevent misuse. Contact us promptly if you suspect unauthorized access.
3. Your content and your responsibilities
3.1 "Your Content" means any file, text, image, or other material you upload or submit, plus the flashcards and other output made from it.
3.2 You need the right to upload it. You represent and warrant that for everything you upload:
- (a) you own it, or you have every permission, license, or authorization needed to upload it and have it processed as these Terms describe; and
- (b) uploading and processing it does not violate any law, anyone's intellectual property or privacy rights, or any policy, honor code, syllabus, or rule of your school, instructor, or course.
3.3 Course materials and academic integrity. Lecture slides, handouts, exams, problem sets, and other course materials are often owned by your instructor or institution, and many schools limit sharing them or putting them into third-party or AI tools without permission. Before uploading any course material, it's your job to find out whether your instructor or institution allows it, and to get permission if it's required. Don't upload:
- materials your instructor or institution has told you not to share or upload;
- exams, quizzes, answer keys, or assessment materials, unless you're clearly allowed to;
- anything you'd use to get an unfair academic advantage or break an academic integrity policy.
3.4 We don't check permissions. Hamstr can't know your school's rules or whether you have permission, and we don't review uploads for it. You alone are responsible for how you use the Service, including following your institution's academic integrity policies. Nothing Hamstr makes counts as approval to use it in any course, assignment, or assessment.
3.5 Ownership and license to us. You keep whatever rights you have in Your Content. You give Hamstr a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and change Your Content (and to send it to our service providers, including AI model providers) only as needed to run, secure, and support the Service for you and meet applicable legal obligations. We don't sell Your Content, publish it, or share it with other users as a Service feature. We don't use your uploads or study data to train AI models. Processing by our providers and limited disclosures for copyright complaints, legal obligations, or a business transfer are described in the Privacy Policy. This licence does not give us ownership or permission to exploit Your Content for unrelated purposes. It ends when the relevant content is deleted from our systems, except for limited retention and processing described in the Privacy Policy. Output may not be unique or eligible for copyright protection, and you receive no rights in third-party material beyond those you already have.
4. Acceptable use
You agree not to:
- upload content that infringes someone's copyright, trademark, privacy, or other rights;
- use the Service to break any law or any academic integrity, honor code, or conduct policy that applies to you;
- share, sell, or distribute course materials or Hamstr output in a way the rights holder hasn't allowed;
- upload malware, or try to break into, overload, reverse-engineer except where the law permits it, or get around limits or security in the Service;
- resell the Service, or use automated means to access it except through features we provide;
- use the Service to harass anyone or to make unlawful, harmful, or sexually exploitative content.
We may remove content, limit features, or suspend or end accounts that we reasonably believe break these Terms.
5. Copyright complaints
We respect copyright. A rights holder or authorized representative can send a complaint to:
Copyright Contact, Hamstr · officialbreezeadmin@gmail.com
Please include:
- your name and contact details, and whether you own the copyright or act for its owner;
- a description of the copyrighted work and your rights in it;
- enough information for us to locate the material, such as a deck or card identifier, a screenshot, or an account identifier you already know; private material may not have a public URL;
- the alleged infringement, including its date and time if known;
- a statement that you believe in good faith that the use is not authorized by the rights holder, their agent, or the law; and
- a statement that the information is accurate, and your electronic or physical signature.
We review complaints promptly, may ask for missing information, and may restrict or remove material where appropriate. A complaint is an allegation, not a finding of infringement. We consider explanations about permission, mistaken identification, and applicable copyright exceptions. We terminate repeat infringers' accounts in appropriate circumstances.
Canadian notices. Where Canada's Copyright Act requires it, we forward compliant notices to the affected user, tell the sender whether forwarding succeeded, and preserve the required identifying records for the statutory period. A Canadian notice alone does not automatically require removal or disclosure of the user's identity. Notices under that process must not contain a settlement offer, a payment demand, a request for personal information, or a link to such a request or offer.
U.S. complaints. This is our copyright contact, not a registered U.S. DMCA designated agent. You may submit a U.S. copyright complaint here; include your mailing address and telephone number and a statement, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.
If your material is restricted. Unless legally prohibited, we notify you and explain how to respond. Email the contact above with the affected material's identifier and why you believe the restriction was mistaken, including any permission you have. We review your response and may restore the material if appropriate and lawful. We may share relevant complaint or response information with the other party as permitted or required by law, as explained in the Privacy Policy. Avoid including unrelated personal information.
6. AI output
Flashcards and other output are generated automatically and may be wrong, incomplete, or misleading. Check anything important against your original sources. Don't rely on output for medical, legal, safety, or other professional decisions.
7. Plans, payment, and cancellation
Plans and billing. Paid plans are billed through Stripe. Before you subscribe, we show the price, currency, applicable taxes, billing interval, included features and limits, any promotional terms, and whether the plan renews automatically. The plan details you accept form part of these Terms. We provide a copy of your contract in a form you can save within 15 days after you subscribe, or sooner if required by law.
Cancellation. For a recurring plan, you authorize the recurring charges disclosed at purchase until cancellation. Cancel through Manage plan in the Service, which opens Stripe's billing page, or by emailing officialbreezeadmin@gmail.com. You can cancel renewal at any time, before or after a renewal date, without a cancellation fee. Ordinarily, access continues until the end of the paid billing period and no further renewal charges are made. Uninstalling the app does not cancel billing. If you request account deletion, we also stop future renewals; see Section 12.
Refunds. Payments aren't refundable for partial billing periods. If you were charged by mistake, or a problem on our end kept you from using a paid plan, email us within 14 days of the charge and we'll refund that charge. Any stated refund restriction is subject to your rights under applicable law, including rights arising from missing disclosures, failure to provide a contract copy, or failure to supply the Service. Contact us at officialbreezeadmin@gmail.com to request a refund or exercise a cancellation right; you may also use any method allowed by law.
BC renewals. Where BC subscription rules apply, renewals of 60 days or less may be cancelled without fees before or after renewal; that cancellation alone does not require a refund for unused time. For a renewal longer than 60 days, we give notice 30-60 days before renewal explaining the renewal date, how to cancel, your cancellation rights, and that renewal occurs if you do not respond. You may cancel before renewal without penalty or after renewal with the unused-portion refund required by law, issued within 15 days. These rights override the ordinary end-of-period cancellation and refund terms above.
Changes to paid plans. We may propose changes to prices, features, or generation limits for future billing periods. We will obtain your express agreement before applying a change to your existing subscription. If you do not agree, we will keep your existing terms or give reasonable advance notice that the plan will end and stop future billing. We will honour any cancellation or refund rights the law gives you.
8. Privacy
Our Privacy Policy explains how we collect and use information, including the service providers that process Your Content (currently Supabase for accounts and storage, Stripe for payments, Railway and Vercel for hosting, and Together AI for running AI models).
9. Disclaimers
The Service is provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties and conditions, including merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We don't promise uninterrupted or error-free service, particular grades or learning results, or that your institution allows you to use Hamstr.
Nothing in these Terms excludes a warranty, condition, remedy, or consumer right that cannot lawfully be excluded. This protection applies to every section, including payment, liability, indemnification, and disputes.
10. Limitation of liability
To the extent the law allows, Hamstr and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or losses of profits, data, or academic standing arising from the Service. This includes academic discipline, grade penalties, suspension, or expulsion arising from your breach of your institution's rules.
Subject to the exceptions below, our total liability for claims arising from the Service is limited to the greater of the fees you paid us in the 12 months before the event giving rise to the claim or US $50, whether the claim is based on contract, negligence, or another legal theory.
These exclusions and the cap do not apply to our fraud, intentional misconduct, gross negligence, or any liability that the law does not allow us to exclude or limit. They do not reduce statutory refunds or other non-waivable consumer or privacy rights. Where a limit is not allowed, it does not apply.
11. Indemnification
To the extent the law allows, you agree to reimburse Hamstr and its operator for reasonable losses and legal costs from a third-party claim, but only to the extent caused by your knowing or negligent breach of Section 3 or 4, including uploading materials without required permission or violating applicable academic integrity rules. This does not cover losses caused by our own breach of these Terms, negligence, or misconduct, and it does not apply where the law protects you from this obligation, including protections for minors.
We will notify you promptly of a claim, take reasonable steps to limit losses, and give you a reasonable opportunity to participate in its handling. We will not agree to a settlement that requires you to pay, admit fault, or take action without your written consent. You are not required to fund or take over our defence in advance.
12. Ending your use
You can stop using the Service at any time. To request account deletion, email officialbreezeadmin@gmail.com; account deletion is handled by email, not an in-app delete button. We stop future subscription renewals when we process the request. To stop an imminent renewal, also cancel through billing controls or explicitly request billing cancellation by email. Deletion and any necessary retention follow the Privacy Policy. Export any study data you want to keep before deletion; we cannot remove copies you have exported or stored on your own devices.
We may suspend or end access where we reasonably believe you have materially broken these Terms, or where needed for legal or security reasons. Where practicable, we give notice, explain the reason, and allow you to respond or correct the problem. We may act immediately where needed to protect the Service, people, or rights holders. If we permanently discontinue a paid Service for reasons unrelated to your breach, we refund prepaid fees for the unused period. Other legally required refunds remain available.
Sections 3.5 (only for the limited purposes stated there), 5, 6, and 9-14 survive only to the extent needed to address rights and obligations arising before termination or lawful retention afterward. Section 7 continues for outstanding billing, cancellation, and refund matters.
13. Disputes and governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Mandatory protections of the place where you live continue to apply where the law requires, including applicable protections in other Canadian provinces and U.S. states.
You may bring a claim in any court or tribunal that has jurisdiction under applicable law, including the courts of British Columbia. You may also contact a regulator or participate in a class proceeding where available. These Terms do not require arbitration or a waiting period before you exercise those rights.
We welcome the opportunity to resolve concerns informally at officialbreezeadmin@gmail.com, but contacting us first is voluntary.
14. General
- Changes. We give advance notice in the app or by email of material proposed changes and obtain your express acceptance before they apply to you. Changes do not apply retroactively to existing claims. Paid-plan changes follow Section 7; new uses of personal information follow the Privacy Policy and applicable consent rules.
- Entire agreement. These Terms, the plan details you accept, and the Privacy Policy form the agreement about the Service, subject to any rights or representations the law does not allow us to exclude. The Privacy Policy controls how we handle personal information; the content licence does not expand those uses.
- Severability. If any part is unenforceable, the rest stays in effect where legally possible.
- No waiver. Not enforcing a right isn't a waiver of it.
- Assignment. You may not transfer your account or this agreement without our consent. We may transfer the agreement as part of a business sale if the successor assumes our obligations and your rights are not reduced. Any personal-information transfer must comply with the Privacy Policy and applicable law.
- Who we are. Hamstr is an independent business based in British Columbia, Canada. It is not a corporation.
